These “terms” are the terms and conditions on which 'or' Collective (“we” or “us” or “our”) lends clothing (“goods” or “rotations”) to you through our website (the “service”)

These terms tell you who we are, how we will provide goods to you, how you and we can change or end the contract, what to do if there is a problem and other important information. Please make sure you read and understand them before you process an order with us.

We may update these terms and aspects of the service from time to time, we will notify such changes via the website (www.orcollective.co.uk). By using the service you agree to be bound by these terms. If you do not agree to these terms then please do not use the services we provide.

We are or Collective limited, a company registered in England and Wales. Our company registration number is 13894559 our Registered address is Santa Maria Anchor Lane, The heath, Dedham, Colchester, Essex, united Kingdom, CO7 6BX. Our registered VAT number is 409689355.

Entering this agreement you agree to receive all communications via email or phone. You agree to keep your email address up to date at all times, and agree that you will be deemed to have received any notices we send to that email address.

3.1.Membership. The service is provided to you when you create an account with us. Once you have created an account you can apply for membership (“membership”) By applying for membership you agree that:

A. you are legally capable of entering into binding contracts

Our acceptance of your membership will take place when we email you to accept it upon submitting your first order. At this point a contract will come into place between you and us. 

If we are unable to accept you membership we will inform you of this and will not charge you for your order or the membership.

3.3 Accuracy of information. It is your responsibility to ensure that all information you upload onto the site is correct and accurate. Please check all information  before processing your order.

3.4 Availability of the service. We reserve the right to withdraw or amend the services without notice. We will not be liable if for any reason any of the services are unavailable for any time or period. From time to time, we may restrict access to all or part of our services to users that have registered with us.

3.5 Security of information. If you choose, or are provided with, a user ID, password or any other piece of information as part of our security measures, you agree to treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms.

3.6 We only sell to the UK. Our website is solely for the promotion of our Goods in the UK. Unfortunately, we do not accept orders from or deliver to addresses outside the UK.

3.0 Using our services and our contact with you

4.1 Information and Policies. For full information about the Services, including pricing (and other fees), Membership periods and cancellation policies, please see our FAQs. Our FAQs may be amended from time to time without notice to you. You should check the FAQs for any changes.

4.2 Payment for the services. You are solely responsible for:

A. the fee for any membership that you order and is not cancelled in accordance with our cancellation policy

B. The price of any goods that are not returned within the standard 7 day return period. This will be calculated at RRP minus monthly item rental fee x number of months you have had this item. OR Collective reserved the right to charge your card on file for such loss

C. The price of any goods that are damaged beyond wear and tear**. Calculated in the same manner as stated in 4.2 B. Or Collective reserve the right to charge your card on file for such damage.

4.3 Rental fees. The rental fees are listed on the website. Upon subscribing to membership you authorize or Collective and/or our third party payment  processor to charge your payment card for the applicable rental fees. This can be A. monthly recurring fee or B. prepaid quarterly or yearly fee where payment is taken at the start of each subscription period. When subscribing you also authorize us to charge you, where applicable for agreed rental extensions, and for the cost of clothing where there has been excessive damage to or loss by the customer. You will be notified by email 1 day before the charges are taken.

4.4. Returning goods. You agree to return goods to 'or' Collective at the time of your Rotation unless you have agreed to buy any items from or. This can be done through your account.

Goods must be packed, sealed, labelled with your name and ready when your courier arrives. If you are out of catchment and use our third-party delivery services (e.g dpd, Royal mail or Evri) you are responsible to arrange return of your items with the provided label within 7 days of arranging rotation. Should you not return your goods within this timeframe , you agree that or collective may charge you late fees* for up to 6 weeks. Once this 6 week period is over or collective reserve the right to charge your payment card the residual value of the unreturned item.  If you wish to cancel or pause your subscription please visit ‘your membership’ to arrange this before returning. 

*Late fees are charged at 1.50 per item per week.

4.5 Missed deliveries. If your delivery is arranged through Zedify and you miss the delivery or do not provide your return items or collective reserve the right to charge you for the second delivery attempt.

4.6 Rental not purchase. You agree and acknowledge that you are renting and not owning the goods. Ownership of all items in a rotation remains with OR Collective unless you make a purchase to buy the goods. The risk of loss or damage of the clothes  passes to you  once you receive your delivery. You will keep the items in your possession until returning them to OR Collective. 

** To be precise, our wear and tear policy covers all damage listed below: 

Small nicks or holes in expected hard wearing areas (knees, elbows)

Any manufacturing fault will also be considered as a separate matter.

You are responsible for ensuring that your delivery address is correct and accurate. By placing an order with us you give us consent to share your address with a third party courier where applicable.

We are not responsible for failure to deliver or delays that are outside of our control. If such an event occurs we will contact you as soon as possible and take steps to minimise any impact or effects. 

You will have the option to leave a safe location for your delivery if you will not be home, If you do this it is at your own risk and liability. If you are not home and do not advise a safe place to leave the goods they will be returned to our warehouse for you to arrange another delivery time. 

Should you have more than 2 failed delivery attempts we will charge you for the third attempt.

Goods may differ slightly from the image or description on our website. Although we make every effort to show colours and describe products accurately, we cannot be responsible for how your device displays colour. 

To cancel your subscription and be eligible for a refund you must cancel your order in ‘your account’ section of the website and return the items to us within 7 days, unworn and unmarked. You will receive your refund within 14 days of OR Collective receiving the items. 

For general cancellation of services, you may cancel your subscription anytime. We require 7 days to process the items once received and issue any pro-rata refund due. Pro-rata refund is issued from the point when all items are processed back into the business.

In Limited circumstances we may not be able to fulfil your order. In these circumstances OR Collective is entitled to cancel the relevant subscription and refund any pre-payment paid with expectation of receiving a delivery.

Where terms are breached, or Collective is entitled to cancel your account and any future subscriptions and reclaim the full retail price of a bundle.

6.0 Cancellation, refunds, and terminations

Nothing in these terms will restrict your statutory rights. Or Collective limits its liability under these terms to the value of the contract between you and us – the price for the rental subscription payable by you.

Nothing in these terms seeks to exclude or limit OR Collective’s liability for death, personal injury or negligence, or fraud or fraudulent misrepresentation.

or Collective is not liable for any unforeseeable loss or damage. We are also not liable for any defects, faults or issues in the products where they are as a result of the manufacture of the products. All products will be inspected before being sent to you, but we are not liable for any faults that are not visible to the human eye. 

You, the customer will use the products at your own risk, Or Collective is not liable for loss or damage occurring by using the products in any way that is not the intended use. 

Or Collective is not liable for products being delivered to previous or incorrect address in line with the delivery address on the customers’ account and provided the information was notified within 7 days of the delivery. 

We own, or are the licensee to, all right, title and interest in and to the Site and Service, including all rights under patent, copyright, trade secret or trademark law, and any and all other proprietary rights, including all applications, renewals, extensions and restorations thereof. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble or otherwise attempt to derive source code from any part of the Service.
 
 You must not extract or otherwise use any of the content on the Site and/or Service for commercial purposes without obtaining a licence to do so from us or our licensors. You may not use our trade names, trademarks, service marks, or logos in connection with any Goods or service that is not ours, or in any manner that is likely to cause confusion. Nothing included in the Site or Service should be construed as granting any right to use any trade names, trademarks, service marks, or logos without the express prior written consent of the owner.
 
 We respect the intellectual property rights of others. If you believe that any of your intellectual property rights have been infringed on the Site, please contact us on hello@orcollective.co.uk to report the concern.
